{"id":1922,"date":"2026-02-11T15:56:56","date_gmt":"2026-02-11T15:56:56","guid":{"rendered":"https:\/\/foreignnewstoday.com\/?p=1922"},"modified":"2026-02-11T15:56:56","modified_gmt":"2026-02-11T15:56:56","slug":"house-vote-clears-path-to-challenge-trumps-canada-tariffs","status":"publish","type":"post","link":"https:\/\/foreignnewstoday.com\/?p=1922","title":{"rendered":"House vote clears path to challenge Trump\u2019s Canada tariffs"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p>President Donald Trump&#8217;s tariffs may now be challenged in the House following the death of <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-resolution\/1042\/text\">House Resolution 1042<\/a> on Tuesday night. The resolution <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-resolution\/1042\/text\">included<\/a> a procedural measure that would have prevented the House from voting until August to terminate the national emergencies that Trump has used to impose &#8220;reciprocal tariffs.&#8221; Now, the House will <a href=\"https:\/\/www.cbc.ca\/news\/world\/trump-tariffs-canada-house-representatives-vote-congress-9.7084213\">likely vote on Wednesday<\/a> on <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-joint-resolution\/72\/text\">House Joint (H.J.) Resolution 72<\/a>, which, like its <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-joint-resolution\/37\/text\">companion measure in the Senate<\/a> that passed last April, seeks to end the <a href=\"https:\/\/www.congress.gov\/crs_external_products\/IN\/HTML\/IN12533.html\">national emergency<\/a> Trump declared last February and roll back the tariffs subsequently imposed on Canadian goods.<\/p>\n<p>The vote on H.R. 1042, originally scheduled for 1:30 p.m. on Tuesday, was <a href=\"https:\/\/www.fox16.com\/hill-politics\/gop-lawmakers-threaten-to-rebel-on-trump-tariff-vote\/\">pushed back<\/a> to 8:30 p.m. due to a combination of <a href=\"https:\/\/www.newsnationnow.com\/politics\/gop-lawmakers-threaten-to-rebel-on-trump-tariff-vote\/\">wariness and opposition<\/a> from Reps. Tom McClintock (R\u2013Calif.), Victoria Spartz (R\u2013Ind.), Kevin Kiley (R\u2013Calif.), Don Bacon (R\u2013Neb.), and Thomas Massie (R\u2013Ky.). Spartz, Kiley, and Massie all <a href=\"https:\/\/www.congress.gov\/votes\/house\/119-1\/268\">voted<\/a> against <a href=\"https:\/\/reason.com\/2025\/09\/17\/house-republicans-just-voted-to-give-even-more-tariff-power-away-to-trump\/\">a similar resolution<\/a> in September. McClintock, while <a href=\"https:\/\/www.fox16.com\/hill-politics\/gop-lawmakers-threaten-to-rebel-on-trump-tariff-vote\/\">initially part of their coalition<\/a> at that time, ultimately voted for that resolution. He caved this time, too.<\/p>\n<p>McClintock <a href=\"https:\/\/x.com\/RepMcClintock\/status\/2021293303942033522?s=20\">said<\/a> he remains &#8220;a tariff skeptic,&#8221; but voted to pass <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-resolution\/1042\/text\">Tuesday&#8217;s resolution<\/a>, defending his decision by saying &#8220;it would be unwise to alter the status quo until we know the full scope and implications of the decision.&#8221; While Spartz <a href=\"https:\/\/www.newsnationnow.com\/politics\/gop-lawmakers-threaten-to-rebel-on-trump-tariff-vote\/\">told<\/a> <i>The Hill <\/i>earlier on Tuesday that &#8220;we need to stop waiting for the Supreme Court,&#8221; Speaker of the House Mike Johnson (R\u2013La.) <a href=\"https:\/\/x.com\/JakeSherman\/status\/2018728418322571490?s=20\">apparently persuaded her<\/a> to join McClintock in voting for the resolution.<\/p>\n<p>But Republican leaders could not persuade Kiley, Bacon, and Massie to vote &#8220;yes.&#8221; Massie <a href=\"https:\/\/x.com\/RepThomasMassie\/status\/2021433692850356514?s=20\">defended<\/a> his decision to break from party ranks as &#8220;defend[ing] the Constitution,&#8221; which vests &#8220;taxing authority\u2026in the House of Representatives, not the Executive.&#8221; Similarly, Bacon <a href=\"https:\/\/punchbowl.news\/article\/house\/house-tariff-war\/\">said<\/a> he must &#8220;answer to Article I,&#8221; which grants Congress exclusive power to regulate international commerce and impose taxes.<\/p>\n<p>Beginning in February 2025 with his tariffs <a href=\"https:\/\/reason.com\/2025\/01\/23\/trumps-tariffs-will-make-americans-mexicans-and-canadians-poorer\/\">against Canada<\/a> <a href=\"https:\/\/reason.com\/2025\/02\/28\/tariffs-on-imports-from-canada-and-mexico-are-still-a-terrible-idea\/\">and Mexico<\/a>, Trump has invoked the International Emergency Economic Powers Act (IEEPA) to <a href=\"https:\/\/reason.com\/2025\/04\/15\/are-trumps-liberation-day-tariffs-illegal\/\">authorize<\/a> his unilateral modification of the <a href=\"https:\/\/hts.usitc.gov\/\">Harmonized Tariff Schedule<\/a>. Trump used IEEPA in April, and again last summer, <a href=\"https:\/\/reason.com\/2025\/04\/02\/americans-are-deeply-skeptical-of-trumps-liberation-day-tariffs\/\">to impose<\/a> his not-so-reciprocal tariffs on imports from all around the world, <a href=\"https:\/\/reason.com\/2026\/01\/20\/trump-threatens-nato-members-with-tariffs-paid-almost-entirely-by-americans\/\">the burden of which has been almost entirely borne by Americans<\/a>.<\/p>\n<p>Unsurprisingly, to use the International <i>Emergency <\/i>Economic Powers Act, Trump had to declare a national emergency. Such emergencies are subject to congressional review.<\/p>\n<p>The <a href=\"https:\/\/www.congress.gov\/bill\/94th-congress\/house-bill\/3884\">National Emergencies Act<\/a>, which Trump <a href=\"https:\/\/www.congress.gov\/crs_external_products\/IN\/HTML\/IN12533.html\">invoked<\/a> alongside IEEPA in his <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2025-02-07\/pdf\/2025-02406.pdf\">executive order<\/a> imposing tariffs on Canadian imports, requires that Congress shall convene to determine whether the emergency shall continue &#8220;no later than six months after a national emergency is declared and for every six-month period the emergency remains active thereafter,&#8221; <a href=\"https:\/\/www.congress.gov\/crs-product\/R46567\">explains<\/a> the Congressional Research Service. Accordingly, IEEPA <a href=\"https:\/\/uscode.house.gov\/view.xhtml?path=\/prelim@title50\/chapter35&amp;edition=prelim\">provides<\/a> that its authorities &#8220;may not continue to be exercised\u2026if the national emergency is terminated by the Congress.&#8221;<\/p>\n<p>Republicans avoided complying with this unambiguous requirement by redefining what qualifies as a &#8220;day&#8221; in the congressional calendar.<\/p>\n<p>In March 2025, House Republicans passed <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-resolution\/211\/text\">House Resolution 211<\/a>, which <a href=\"https:\/\/reason.com\/2025\/03\/12\/congress-just-made-it-harder-for-congress-to-block-trumps-tariffs\/\">declared<\/a> that &#8220;each day\u2026shall not constitute a calendar day for purposes of\u2026the National Emergencies Act.&#8221; This allowed Trump&#8217;s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/imposing-duties-to-address-the-situation-at-our-southern-border\/\">February 2025 tariffs<\/a> to remain in place until January 3 of this year. In April 2025, Republicans inserted <a href=\"https:\/\/abcnews.go.com\/Politics\/house-gop-moves-prevent-votes-rescinding-trump-tariffs\/story?id=120644968&amp;utm_source=chatgpt.com\">nearly identical language<\/a> in <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-resolution\/313\/text\">House Resolution 313<\/a> to prevent a vote through September on <a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/04\/fact-sheet-president-donald-j-trump-declares-national-emergency-to-increase-our-competitive-edge-protect-our-sovereignty-and-strengthen-our-national-and-economic-security\/\">the &#8220;Liberation Day&#8221; emergency<\/a> that Trump used to impose &#8220;reciprocal&#8221; tariffs. Then, in September, Republicans <a href=\"https:\/\/reason.com\/2025\/09\/17\/house-republicans-just-voted-to-give-even-more-tariff-power-away-to-trump\/\">repeated the procedural gimmick<\/a> by passing <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-resolution\/707\/text\">House Resolution 707<\/a> to stall a vote on that national emergency <a href=\"https:\/\/www.ntu.org\/publications\/detail\/the-house-of-representatives-should-not-change-its-rules-to-circumvent-the-national-emergencies-act\">until January 31<\/a>.<\/p>\n<p>Nearly two weeks since the end of the Republicans&#8217; National Emergencies Act loophole, Trump&#8217;s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/further-modifying-the-reciprocal-tariff-rates\/\">updated &#8220;reciprocal&#8221; tariff rates<\/a> should be exposed to congressional scrutiny. Now they are, thanks to the Republicans who ended their colleagues&#8217; cowardly bid to save themselves from <a href=\"https:\/\/x.com\/JakeSherman\/status\/2021235237850657208?s=20\">painful votes<\/a>.<\/p>\n<p>But Tuesday&#8217;s vote was only half of the battle.
