senior US officials and their cheerleaders appear to be embracing attacks \u2013 and threats of attacks \u2013 on Iranian civilian infrastructure, which legal experts say appears to constitute serious war crimes under international law.<\/p>\n<p class=\"dcr-130mj7b\">In his rambling national address on Wednesday, the US president warned that if <a href=\"https:\/\/www.theguardian.com\/world\/iran\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Iran<\/a> did not reach an unspecified deal with him, US forces would \u201chit each and every one of their electric-generating plants\u201d and \u201cbring [Iran] back to the stone ages \u2013 where they belong\u201d.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/www.axios.com\/2026\/04\/02\/trump-iran-bridge-stone-age\" data-link-name=\"in body link\">Following through on that threat<\/a> a day later, Trump posted images of a <a href=\"https:\/\/www.theguardian.com\/world\/2026\/apr\/02\/trump-warns-tehran-more-to-follow-after-strike-destroys-irans-largest-bridge\" data-link-name=\"in body link\">strike on an the unfinished B1 bridge<\/a> near Tehran, warning: \u201cMuch more to follow!\u201d<\/p>\n<p class=\"dcr-130mj7b\">Erika Guevara Rosas, Amnesty International\u2019s senior director of research, advocacy, policy and campaigns said: \u201cIntentionally attacking civilian infrastructure such as power plants is generally prohibited. .<\/p>\n<figure id=\"407a800b-7a73-411a-94e8-2e541bae3456\" data-spacefinder-role=\"richLink\" data-spacefinder-type=\"model.dotcomrendering.pageElements.RichLinkBlockElement\" class=\"dcr-47fhrn\"><gu-island name=\"RichLinkComponent\" priority=\"feature\" class=\"dcr-130mj7b\">\u201cEven in the limited cases that they qualify as military targets, a party still cannot attack power plants if this may cause disproportionate harm to civilians.<\/p>\n<p class=\"dcr-130mj7b\">\u201cGiven that such power plants are essential for meeting the basic needs and livelihoods of tens of millions of civilians, attacking them would be disproportionate and thus unlawful under international humanitarian law, and could amount to a war crime.\u201d<\/p>\n<p class=\"dcr-130mj7b\">That principle was underlined in 2024 when the international criminal court <a href=\"https:\/\/www.icc-cpi.int\/news\/situation-ukraine-icc-judges-issue-arrest-warrants-against-sergei-ivanovich-kobylash-and\" data-link-name=\"in body link\">issued arrest warrants<\/a> for the Russian politician and a former defence minister, Sergei Shoigu and the Russian general Valery Gerasimov, who were accused of directing widespread attacks on Ukraine\u2019s <a href=\"https:\/\/www.icc-cpi.int\/news\/situation-ukraine-icc-judges-issue-arrest-warrants-against-sergei-kuzhugetovich-shoigu-and\" data-link-name=\"in body link\">power infrastructure and of causing excessive harm to civilians.<\/a><\/p>\n<p class=\"dcr-130mj7b\">On Thursday, more than 100 US experts in international law from universities including Harvard, Yale, Stanford and the University of California, said the conduct of US forces and statements \u2060by senior US officials \u201craise serious concerns about violations of international human rights law and international humanitarian law, including potential \u200cwar crimes\u201d.<\/p>\n<figure id=\"c2e3d891-3060-4e58-8fbd-bdfa004770be\" data-spacefinder-role=\"inline\" strikes on Iran \u201cjust for fun\u201d. It also cited comments by the defence secretary, Pete Hegseth, who told reporters <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/mar\/08\/pete-hegseth-pentagon-trump-iran\" data-link-name=\"in body link\">the US did not fight \u2060with \u201cstupid rules of \u2060engagement\u201d.<\/a><\/p>\n<p class=\"dcr-130mj7b\">The experts said they were \u201cseriously concerned about strikes that have hit \u200cschools, health facilities, and homes\u201d, noting an attack on a school in Tehran on the first day of the war that killed more than 160 children and teachers.<\/p>\n<figure id=\"40c16713-669b-452c-be21-3b4e5da35ef6\" data-spacefinder-role=\"richLink\" data-spacefinder-type=\"model.dotcomrendering.pageElements.RichLinkBlockElement\" class=\"dcr-47fhrn\"><gu-island name=\"RichLinkComponent\" priority=\"feature\" deferuntil=\"idle\" props=\"{&quot;richLinkIndex&quot;:12,&quot;element&quot;:{&quot;_type&quot;:&quot;model.dotcomrendering.pageElements.RichLinkBlockElement&quot;,&quot;prefix&quot;:&quot;Related: &quot;,&quot;text&quot;:&quot;\u2018Her head was broken\u2019: parents at Iranian school bombed by US describe their worst day&quot;,&quot;elementId&quot;:&quot;40c16713-669b-452c-be21-3b4e5da35ef6&quot;,&quot;role&quot;:&quot;richLink&quot;,&quot;url&quot;:&quot;https:\/\/www.theguardian.com\/global-development\/2026\/mar\/28\/parents-victims-iran-minab-shajareh-tayyebeh-school-bombing-describe-day&quot;},&quot;ajaxUrl&quot;:&quot;https:\/\/api.nextgen.guardianapps.co.uk&quot;,&quot;format&quot;:{&quot;design&quot;:6,&quot;display&quot;:0,&quot;theme&quot;:0}}\"\/><\/figure>\n<p class=\"dcr-130mj7b\">The two issues of <a href=\"https:\/\/ihl-databases.icrc.org\/en\/customary-ihl\/v1\/rule10\" data-link-name=\"in body link\">what constitutes a civilian object<\/a> and the consideration of proportionality in striking civilian objects that a belligerent has identified as having a military function are among the knottier questions in international humanitarian law.<\/p>\n<p class=\"dcr-130mj7b\">Under article 52 of the first additional protocol to the <a href=\"https:\/\/www.theguardian.com\/law\/geneva-conventions\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Geneva conventions<\/a> of 1977, \u201ccivilian objects\u201d, such as infrastructure, are defined not in themselves but by what they are not: military objectives whose destruction offers no definite military advantage.<\/p>\n<p class=\"dcr-130mj7b\">At the heart of the question of what may \u2013or may not \u2013 be attacked is the overarching <a href=\"https:\/\/ihl-databases.icrc.org\/en\/customary-ihl\/v1\/rule1\" data-link-name=\"in body link\">principle of distinction<\/a> between civilians and combatants. Rule 10 of the customary rules international humanitarian law \u2013 relating to both international and internal armed conflicts \u2013 explicitly states: \u201cCivilian objects are protected against attack, unless and for such time as they are military objectives.\u201d<\/p>\n<p class=\"dcr-130mj7b\">That places a requirement on all parties: attackers must avoid targeting civilian objects and the party under attack must avoid \u201cmingling\u201d the military and civilians.<\/p>\n<p class=\"dcr-130mj7b\">Codified in international law, the statute of the international criminal court also makes it explicit that it is a war crime intentionally to direct attacks against civilian objects if they \u201care not military objectives\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Even when a civilian object is deemed to have become a military object, international law requires an attacking party to balance the harm to the civilian population.<\/p>\n<figure id=\"867f780a-d072-4db1-a457-462d06a21835\" data-spacefinder-role=\"inline\" data-spacefinder-type=\"model.dotcomrendering.pageElements.ImageBlockElement\" class=\"dcr-173mewl\"><figcaption data-spacefinder-role=\"inline\" class=\"dcr-fd61eq\"><span class=\"dcr-1inf02i\"><svg width=\"18\" height=\"13\" viewbox=\"0 0 18 13\"><path d=\"M18 3.5v8l-1.5 1.5h-15l-1.5-1.5v-8l1.5-1.5h3.5l2-2h4l2 2h3.5l1.5 1.5zm-9 7.5c1.9 0 3.5-1.6 3.5-3.5s-1.6-3.5-3.5-3.5-3.5 1.6-3.5 3.5 1.6 3.5 3.5 3.5z\"\/><\/svg><\/span><span class=\"dcr-1qvd3m6\">The Gandhi hospital in Tehran, which was hit in the first days of US-Israeli strikes.<\/span> Photograph: Vahid Salemi\/AP<\/figcaption><\/figure>\n<p class=\"dcr-130mj7b\">International law has become more explicit and precise over the issue of the protection of civilian objects since the second world war, but the US and western allies have launched questionable attacks on civilian infrastructure before, including against Iraq in the 1991 Gulf war snf on Serbian power plants.<\/p>\n<p class=\"dcr-130mj7b\">The crippling of Iran\u2019s power plants would be \u201cdevastating to the Iranian people\u201d, cutting off electricity to hospitals, water supplies and other vital civilian needs, said Sarah Yager, the Washington director of Human Rights Watch.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe <a href=\"https:\/\/www.theguardian.com\/us-news\/us-military\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">US military<\/a> has protocols designed to constrain that kind of harm to the civilian population, but when the president speaks this way, it risks signalling that those constraints are optional, and that is what makes this moment so dangerous,\u201d she said.<\/p>\n<p class=\"dcr-130mj7b\">International law permits attacks on energy plants and other ostensibly civilian targets only if determined that they primarily support military activity. But Trump\u2019s statements indicate otherwise, said Tom Dannenbaum, a professor at Stanford Law School.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe reference to the stone age indicates that objects would be targeted seemingly because they contribute to the viability of a modern society in Iran, which is completely unrelated to the question of contribution to military action \u2013the necessary condition for targeting in war,\u201d he said.<\/p>\n<p class=\"dcr-130mj7b\">Attacks on civilian objects by both Iran, the US and Israel have prompted a pointed response from the president of the international committee, Mirjana Spoljaric, who said war crimes may be being committed.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWar on essential infrastructure is war on civilians \u2026 Deliberate attacks on essential services and civilian infrastructure can amount to war crimes.
