{"id":43580,"date":"2026-04-07T06:55:21","date_gmt":"2026-04-07T06:55:21","guid":{"rendered":"https:\/\/foreignnewstoday.com\/?p=43580"},"modified":"2026-04-07T06:55:21","modified_gmt":"2026-04-07T06:55:21","slug":"australias-most-decorated-soldier-ben-roberts-smith-arrested-over-alleged-war-crimes-in-afghanistan","status":"publish","type":"post","link":"https:\/\/foreignnewstoday.com\/?p=43580","title":{"rendered":"Australia\u2019s most decorated soldier Ben Roberts-Smith arrested over alleged war crimes in Afghanistan"},"content":{"rendered":"<p><br \/>\n<br \/><img decoding=\"async\" src=\"https:\/\/i.dawn.com\/large\/2026\/04\/0711340724cddfd.webp\" \/><\/p>\n<p>Australia\u2019s most decorated living soldier was arrested on Tuesday and \u200bwill be charged with five counts of war crime murders relating to the killing of unarmed civilians while on \u200cdeployment in Afghanistan.<\/p>\n<p>The man, whom police identified as a 47-year-old former Australian Defence Force (ADF) member and media named as Ben Roberts-Smith, was arrested at Sydney Airport on Tuesday morning.<\/p>\n<p>He will be charged with five counts of war crimes in<a href=\"https:\/\/www.dawn.com\/news\/1591352\"> connection<\/a> to the murder of five people in Afghanistan between 2009 and 2012, \u200bAustralian Federal Police (AFP) said. The maximum penalty for each charge is life imprisonment.<\/p>\n<p>Roberts-Smith was hailed as a national hero after \u200bbeing <a href=\"https:\/\/www.dawn.com\/news\/1858692\">awarded<\/a> several top military honours, including the Victoria Cross, for his actions during six tours of \u2060Afghanistan from 2006 to 2012.<\/p>\n<p>\u201cIt will be alleged the victims were not taking part in hostilities at the time of their alleged \u200bmurder in Afghanistan,\u201d AFP Commissioner Krissy Barrett told a press conference.<\/p>\n<p>\u201cIt will be alleged the victims were detained, unarmed and were under \u200bthe control of ADF members when they were killed.\u201d<\/p>\n<p>Police would also allege the victims were shot by the accused or shot by subordinates acting on his orders and in his presence, she said.<\/p>\n<figure class=\"media  w-full  w-full  media--left    media--uneven  media--stretch\" data-original-src=\"https:\/\/www.youtube.com\/watch?v=kuP_uCp0N6Y\">\n<div class=\"media__item  media__item--youtube  \"><\/div>\n<\/figure>\n<p>Roberts-Smith has consistently denied allegations of wrongdoing during his service, some of which were first reported by <em>Nine Entertainment<\/em> newspapers \u200bin a series of articles starting in 2018.<\/p>\n<p>Among the accusations reported were that Roberts-Smith had shot dead an unarmed Afghan teenager and \u200bkicked a handcuffed man off a cliff before ordering him to be shot dead.<\/p>\n<p>Roberts-Smith unsuccessfully challenged the reports in what became Australia\u2019s most expensive defamation \u200ctrial, with \u2060a Federal Court judge <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/www.reuters.com\/world\/australian-war-veteran-loses-defamation-lawsuit-over-afghan-killings-2023-06-01\/\"><u>ruling in 2023<\/u><\/a> that the newspapers proved four of the six murder accusations they levelled. A final appeal bid was dismissed by the high court in September 2025.<\/p>\n<p>A 2020 report found credible evidence that members of Australia\u2019s Special Air Service Regiment (SAS) killed dozens of unarmed prisoners in the lengthy Afghan war.<\/p>\n<p>An investigation into the SAS soldier by the AFP and the Office of the Special Investigator (OSI), \u200bset up to examine allegations of \u200bwar crimes by Australian defence \u2060forces in Afghanistan, was opened in 2021.<\/p>\n<p>Ross Barnett, director of investigations at the OSI, said the process was complex and time-consuming because authorities were unable to go to Afghanistan and access the crime scenes.<\/p>\n<p>\u201cWe don\u2019t have \u200baccess to the crime scenes, we don\u2019t have photographs, site plans, measurements, the recovery of projectiles, \u200bblood spatter analysis, \u2060all of those things we would normally get at a crime scene,\u201d he said at the press conference.<\/p>\n<p>The joint OSI-AFP commenced 53 investigations involving allegations of war crimes by ADF members in Afghanistan, with 10 ongoing.
