Approves Constitutional Reform to &#8216;Safeguard&#8217; Abortion"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p class=\"subheading\">Spain\u2019s socialist government on Tuesday greenlit a constitutional reform bill seeking to \u201csafeguard\u201d abortion by enshrining it as a \u201cright\u201d in the nation\u2019s core legal text.<\/p>\n<p class=\"a9d-pre\">The\u00a0<em>La Moncloa<\/em> presidential palace <a href=\"https:\/\/www.lamoncloa.gob.es\/consejodeministros\/resumenes\/paginas\/2026\/070426-rueda-de-prensa-ministros.aspx\">detailed\u00a0<\/a>the constitutional amendment draft was approved by the Spanish Council of Ministers following a months-long process after the proposal was first brought forth in <a href=\"https:\/\/www.lamoncloa.gob.es\/consejodeministros\/resumenes\/paginas\/2025\/141025-rueda-de-prensa-ministros.aspx\">October<\/a>.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a9d\"\/>\n<figure id=\"M-ROS-B1\" class=\"a9d\"\/>\n<figure id=\"gmxrevmore\" class=\"H\"\/>\n<p>The proposal, which will now be sent to the Spanish Parliament, calls for the inclusion of a fourth paragraph to Article 43, to \u201crecognize and protect women\u2019s sexual and reproductive rights.\u201d<\/p>\n<p>The proposed paragraph read:<\/p>\n<blockquote>\n<p>\u201cPublic authorities shall guarantee women\u2019s right to voluntary termination of pregnancy under conditions of real and effective equality, providing all the benefits and services necessary for the exercise of that right.\u201d<\/p>\n<\/blockquote>\n<p>Presently, <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1978-31229#:~:text=Jurisprudencia-,Art%C3%ADculo%2043,-1.%20Se%20reconoce\">Article 43<\/a> of the Spanish constitution contains three paragraphs recognizing the right to health protection and social care, and holding public authorities as responsible to organize public health services. The text also calls for public authorities to promote health education, physical education, and sports, as well as facilitate the proper use of leisure time.<\/p>\n<figure id=\"D-ROS-B2\" class=\"a9d\"\/>\n<figure id=\"M-ROS-B2\" class=\"a9d\"\/>\n<p>The Spanish Equality Ministry celebrated the bill through a series of social media posts proclaiming that Spain \u201cis making progress toward the social and legal recognition of women\u2019s right to self-determination and the necessary protection against regressive trends.\u201d<\/p>\n<p><iframe src=\"https:\/\/www.breitbart.com\/t\/assets\/html\/tweet-5.html#2041470183164809543\" data-btlnk=\"https:\/\/twitter.com\/IgualdadGob\/status\/2041470183164809543\" class=\"bnn-if-tweet\" loading=\"lazy\" width=\"560\" height=\"260\" frameborder=\"0\" scrolling=\"no\" allowtransparency=\"true\" allowfullscreen=\"true\"><\/iframe><\/p>\n<p>Equality Minister Ana Redondo noted on Tuesday that the new proposed fourth paragraph, now validated by the Council of Ministers, is \u201ccompletely constitutional,\u201d with some modifications from its original October draft.<\/p>\n<p>Redondo justified the need to include abortion rights in the Spanish constitution on three grounds.<\/p>\n<p>The first, she said, is the need to respond to \u201can ultra-reactionary movement that has targeted women\u2019s sexual and reproductive rights both globally and here in our country.\u201d<\/p>\n<p class=\"a9d-pre\">The second is to strengthen the Constitutional Court\u2019s case law and \u201cexpand the legal grounds for upholding women\u2019s right to voluntarily terminate their pregnancies.\u201d The third, she said, it\u2019s a matter of \u201ccoherence.\u201d<\/p>\n<figure id=\"M-ROS-B3\" class=\"a9d adSo\"\/>\n<p>\u201cWe are a people who embrace democracy, women\u2019s rights, and equality, and we must enshrine these values in the Constitution as well.\u201d<\/p>\n<p>The Spanish government pointed out that since Article 43 is part of the Spanish constitution\u2019s chapter on the guiding principles of social and economic policy, any amendment to it must follow the standard amendment procedure. As such, Redondo acknowledged, it \u201crequires qualified majorities, broad consensus, and extensive dialogue.\u201d<\/p>\n<p>To be approved, the bill requires the support of at least three-fifths of both chambers of the Spanish parliament. <em>La Moncloa<\/em> further explained that if such a broad majority is not achieved, a joint parliamentary committee will redraft and propose a text to be voted on again.<\/p>\n<p>If it does not pass in this manner either, the reform may be approved with the favorable vote of two-thirds of the Lower House and an absolute majority at the Senate.
