The suspect behind the murder of Ukrainian refugee Iryna Zarutska, who was stabbed to death on a North Carolina train, has been found \u201cincapable to proceed\u201d to trial.<\/p>\n
In a motion that was filed on Tuesday, it was revealed that Decarlos Brown Jr. \u2014 the man who was arrested and charged with first-degree murder after Zarutska\u2019s death, had undergone an evaluation at Central Regional Hospital, WBTV News reported<\/a>.<\/p>\n Brown was found to be \u201cincapable to proceed,\u201d a report from December 29, 2025 said, according to the outlet.<\/p>\n Per the outlet, \u201cBrown\u2019s public defender is asking the court to continue the case,\u201d and the Mecklenburg County District Attorney\u2019s Office \u201cagreed\u201d that the case should be continued:<\/p>\n In the court motion filed Tuesday, Brown\u2019s attorney claimed that the court required capacity hearing cannot take place as long as Brown remains in federal custody. The attorney also argued that the court can\u2019t order to restore Brown\u2019s capacity while he\u2019s in federal custody.<\/p>\n According to the court filing, the Mecklenburg County District Attorney\u2019s Office agreed with the case being continued.<\/p>\n Brown has also been ordered to undergo a psychiatric examination as part of his federal court case. However, court filings from March 6 indicate the examination isn\u2019t completed and the evaluation period has been extended.<\/p>\n<\/blockquote>\n\n
