IBM reached a settlement with the federal government on Friday, agreeing to pay $17,077,043 to resolve allegations of \u201cwoke unconstitutional\u201d diversity, equity, and inclusion (DEI) practices in hiring and employment.<\/p>\n
Acting Attorney General Todd Blanche announced the settlement agreement in a press release<\/a> Friday.<\/p>\n \u201cRacial discrimination is illegal, and government contractors cannot evade the law by repackaging it as DEI,\u201d said Blanche in a statement. \u201cThe Department launched the Civil Rights Fraud Initiative to root out this misconduct, hold offenders accountable, and end this practice for good.\u201d<\/p>\n Associate Attorney General Stanley Woodward added: \u201cMerit drives promotion and opportunity. Not someone\u2019s sex or race. Today\u2019s settlement proves this Department\u2019s commitment to ensure companies are not using taxpayer funded work to further woke unconstitutional practices in American workplaces.\u201d<\/p>\n The Department of Justice (DOJ) had alleged that the New York-based technology giant \u201cknowingly\u201d made \u201cfalse claims\u201d about its hiring and employment practices in its federal contracts by identifying \u201cdiverse\u201d candidates for hiring or promotions, while developing \u201crace and sex demographic goals,\u201d according to the settlement<\/a>.<\/p>\n \u201cThe Nation\u2019s anti-discrimination laws are clear and reflect our basic commitment that opportunity, compensation, and advancement should turn on merit and performance, and not immutable characteristics,\u201d said Deputy Assistant Attorney General Brenna E. Jenny.<\/p>\n She added, \u201cWhen a company accepts federal funding while engaging in practices that sort, prefer, or disadvantage employees on the basis of race or sex, the company is stepping outside the conditions under which the government agreed to contract with them, and we will hold them accountable.\u201d<\/p>\n IBM denied has denied that it had discriminatory and illegal DEI practices and said the settlement does not mean \u201can admission of liability,\u201d the company told<\/a> CNN.<\/p>\n \u201cIBM is pleased to have resolved this matter,\u201d an IBM spokesperson wrote in an email to the news network. \u201cOur workforce strategy is driven by a single principle: having the right people with the right skills that our clients depend on.\u201d<\/p>\n As Breitbart News has reported,<\/a> the Trump administration has been cracking down on DEI practices in public and private sectors since early in the president\u2019s second term.<\/p>\n On day one, President Donald Trump signed an order titled, \u201cEnding Radical And Wasteful Government DEI Programs And Preferencing,\u201d describing the programs implemented by the Biden administration as \u201cillegal and immoral discrimination programs.\u201d<\/p>\n Under Trump, the DOJ has used the False Claims Act, which dates back to the Civil War, to reign in college DEI practices, the statute allowing the government to recover damages and assess penalties when violations occur.<\/p>\n The Trump administration\u2019s campaign to end DEI practices has sent some Democrats into hyperbolic overdrive.<\/p>\n \u201cWhen you attack diversity, equity, and inclusion, you attack the United States of America,\u201d House Democratic Leader Hakeem Jeffries (D-NY) railed<\/a> this week. \u201cWe have the high ground on this issue.\u201d<\/p>\n The DOJ explained the elements of the enforcement in its Friday announcement:<\/p>\n Most federal contracts contain provisions that require contractors to comply with anti-discrimination requirements as to employees and applicants for employment.
