{"id":49579,"date":"2026-04-13T14:24:59","date_gmt":"2026-04-13T14:24:59","guid":{"rendered":"https:\/\/foreignnewstoday.com\/?p=49579"},"modified":"2026-04-13T14:24:59","modified_gmt":"2026-04-13T14:24:59","slug":"judge-dismisses-trump-suit-against-wall-street-journal-over-epstein-birthday-letter-for-now","status":"publish","type":"post","link":"https:\/\/foreignnewstoday.com\/?p=49579","title":{"rendered":"Judge dismisses Trump suit against Wall Street Journal over Epstein birthday letter for now"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div id=\"\">\n<p>A federal judge in Miami handed President Trump a defeat in his <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-lawsuit-wall-street-journal-jeffrey-epstein-birthday-letter\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">defamation lawsuit<\/a><\/span> against the Wall Street Journal over a story about a birthday book for Jeffrey Epstein, saying the president&#8217;s legal team failed to clear the legal bar needed to bring the case.<\/p>\n<p>In a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.693830\/gov.uscourts.flsd.693830.59.0_2.pdf\" target=\"_blank\" rel=\"noopener\">17-page ruling<\/a>, Judge Darrin Gayles of the U.S. District Court of the Southern District of Florida ruled that the president came &#8220;nowhere close&#8221; to showing the paper acted with &#8220;actual malice&#8221; towards him, the standard for bringing a defamation suit as a public figure.\u00a0<\/p>\n<p>Actual malice requires that plaintiffs prove that statements made about a public figure were published with the knowledge that they were knowingly false, or with disregard over whether they are true or not.<\/p>\n<p>&#8220;Because President Trump has not plausibly alleged that Defendants published the Article with actual malice, both Counts must be dismissed,&#8221; Gayles wrote.\u00a0<\/p>\n<p>However, the judge said Mr. Trump can refile the case by April 27 to amend the complaint and allege the paper acted with actual malice.<\/p>\n<p>Gayles added that Mr. Trump&#8217;s &#8220;conclusory allegation&#8221; in the complaint \u2014 that the Journal &#8220;had contradictory evidence and failed to investigate&#8221; \u2014 is &#8220;rebutted by the Article and is insufficient to establish actual malice.&#8221;<\/p>\n<p>A spokesman for Mr. Trump&#8217;s legal team said the president &#8220;will follow Judge Gayles&#8217;s ruling and guidance to refile this powerhouse lawsuit against the Wall Street Journal and all of the other Defendants.&#8221;<\/p>\n<p>&#8220;The President will continue to hold accountable those who traffic in Fake News to mislead the American People,&#8221; the spokesman said.<\/p>\n<p>CBS News has reached out to the White House for comment on the ruling.<\/p>\n<p>The Journal <a href=\"https:\/\/www.wsj.com\/politics\/trump-jeffrey-epstein-birthday-letter-we-have-certain-things-in-common-f918d796\" target=\"_blank\" rel=\"noopener\">reported<\/a> in 2025 that a book with letters from Epstein&#8217;s friends prepared for his 50th birthday in 2003 included a &#8220;bawdy&#8221; message inside the outline of a nude woman with Mr. Trump&#8217;s signature underneath. The president dismissed the story as &#8220;FAKE&#8221; and <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-lawsuit-wall-street-journal-jeffrey-epstein-birthday-letter\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">filed a $20 billion lawsuit<\/a><\/span> against the paper, its parent company News Corp., the company&#8217;s CEO, the reporters who wrote the story and Rupert Murdoch.<\/p>\n<p>House lawmakers later <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/live-updates\/jeffrey-epstein-donald-trump-birthday-message-house-oversight\/\" data-invalid-url-rewritten-http=\"\">obtained<\/a><\/span> a redacted version of the birthday book from Epstein&#8217;s estate, which <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/live-updates\/jeffrey-epstein-donald-trump-birthday-message-house-oversight\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">included the letter<\/a><\/span> at the center of Mr. Trump&#8217;s lawsuit.
