how to implement the <a href=\"https:\/\/www.theguardian.com\/society\/2025\/apr\/16\/uk-supreme-court-legal-definition-woman\" data-link-name=\"in body link\">supreme court ruling on gender<\/a> after the government requested changes to the original proposals submitted last year.<\/p>\n<p class=\"dcr-130mj7b\">In a statement, the <a href=\"https:\/\/www.equalityhumanrights.com\/\" data-link-name=\"in body link\">Equality and Human Rights Commission <\/a>(EHRC) said that after \u201cfeedback\u201d from the government, as well as consultation responses and extra legal advice, it had made changes to what is officially known as the code of practice.<\/p>\n<p class=\"dcr-130mj7b\">It follows concern from a number of MPs and groups representing transgender people that the original code, sent to ministers in September under the EHRC\u2019s then-chair, Kishwer Falkner, created a legal minefield for organisations implementing it, and risked in effect excluding transgender people from much of the public realm.<\/p>\n<p class=\"dcr-130mj7b\">The code sets out how businesses and other organisations should respond in practical terms to the <a href=\"https:\/\/www.theguardian.com\/society\/2025\/apr\/16\/uk-supreme-court-legal-definition-woman\" data-link-name=\"in body link\">supreme court ruling that sex in the Equality Act refers only to biological sex<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">Interim advice from the EHRC under Falkner, which was <a href=\"https:\/\/www.theguardian.com\/society\/2025\/oct\/15\/equalities-watchdog-bridget-phillipson-transgender-guidance\" data-link-name=\"in body link\">subsequently withdrawn<\/a>, said the ruling meant transgender people should not be allowed to use toilets meant for the gender they live as, and that in some cases they could not use toilets consistent with their birth sex.<\/p>\n<p class=\"dcr-130mj7b\">In January, <a href=\"https:\/\/www.theguardian.com\/society\/2026\/jan\/27\/ehrc-guidance-single-sex-spaces-new-chair-mary-ann-stephenson\" data-link-name=\"in body link\">the Guardian reported<\/a> that under its new chair, Mary-Ann Stephenson, the EHRC was looking at ways to adapt the formal code to lessen its impact on businesses and to ensure it tried to balance single-sex spaces with the lives of transgender people.<\/p>\n<p class=\"dcr-130mj7b\">In a statement on Tuesday, Stephenson said ministers had \u201crecently provided us with a narrow set of comments on the draft code of practice we submitted in September\u201d.<\/p>\n<p class=\"dcr-130mj7b\">She went on: \u201cHaving considered this feedback alongside consultation responses and further legal analysis, we have made adjustments where they help the code provide legally accurate, practical guidance that is useful to duty bearers.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThese aim to strengthen duty bearers\u2019 understanding of the law and how it applies across a range of the scenarios they encounter day-to-day, so that all service users are treated with dignity and respect, in line with the Equality Act.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The updated code is now with Bridget Phillipson, who as minister for equalities must approve it before it is put before parliament.<\/p>\n<p class=\"dcr-130mj7b\">In a written statement today, Phillipson thanked the EHRC for its updates, adding: \u201cThis government has always supported the protection of single-sex spaces based on biological sex\u201d.<\/p>\n<p class=\"dcr-130mj7b\">She confirmed that the government was unable to make further announcements because it was within the pre-election period for the Scottish and Welsh parliaments, but Maya Forstater, CEO of sex-based rights campaigners Sex Matters, said this was \u201cnot a good excuse\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Forstater raised concerns about \u201cnegotiations and horse-trading\u201d between the government and the EHRC.<\/p>\n<figure data-spacefinder-role=\"inline\" has found another excuse for delaying the guidance,\u201d she said.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe past year\u2019s delay has caused serious harm to countless women. The statement that the government has \u201calways supported the protection of single-sex spaces based on biological sex\u201d is a slap in the face to these women and girls who have faced harassment and hounding from jobs and services for saying the same thing.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Alex Parmar-Yee, director of the Trans+ Solidarity Alliance group, said: \u201cWe\u2019re glad that the government has heard how cruel and unworkable the EHRC\u2019s original proposals were.
