{"id":50489,"date":"2026-04-14T13:23:20","date_gmt":"2026-04-14T13:23:20","guid":{"rendered":"https:\/\/foreignnewstoday.com\/?p=50489"},"modified":"2026-04-14T13:23:20","modified_gmt":"2026-04-14T13:23:20","slug":"federal-judge-declines-to-block-mail-order-abortions-for-now","status":"publish","type":"post","link":"https:\/\/foreignnewstoday.com\/?p=50489","title":{"rendered":"Federal Judge Declines to Block Mail-Order Abortions \u2014 For Now"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p class=\"subheading\"><span style=\"font-weight: 400;\">A federal judge\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.lawd.213952\/gov.uscourts.lawd.213952.258.0.pdf\">declined<\/a> to block the Biden administration\u2019s mail-order abortion scheme\u00a0<\/span>last week \u2014 but he put the U.S. Food and Drug Administration (FDA) on notice as the agency continues its <a href=\"https:\/\/www.breitbart.com\/politics\/2025\/05\/15\/hhs-secretary-rfk-jr-orders-complete-review-of-abortion-pill-after-shocking-study\/\">safety review<\/a> of the abortion drug mifepristone.<\/p>\n<p class=\"a9d-pre\"><span style=\"font-weight: 400;\">U.S. District Judge David Joseph ruled against Louisiana Attorney General Liz Murrill, who asked the court to halt an FDA rule that allows mifepristone to be dispensed through mail as litigation challenging the rule continues. Joseph issued a 37-page memorandum ruling granting the Trump administration\u2019s request to pause the case as the FDA continues its \u201cgood-faith, evidence-based and expeditious review\u201d of the abortion drug\u2019s safety risks, although he indicated the state has standing to sue and is \u201clikely to succeed\u201d in its challenge.<\/span><\/p>\n<figure id=\"D-ROS-B1\" class=\"a9d\"\/>\n<figure id=\"M-ROS-B1\" class=\"a9d\"\/>\n<figure id=\"gmxrevmore\" class=\"H\"\/>\n<p><span style=\"font-weight: 400;\">\u201c\u2026[T]he stay granted to FDA will not remain open-ended,\u201d wrote Judge Joseph, a nominee of President Donald Trump. \u201cFDA has an obligation to act with all deliberate speed to review its past actions and complete a thorough analysis that addresses the deficiencies it has acknowledged. The parties and the American public deserve nothing less. Should the agency fail to complete its review and make any necessary revisions to the REMS within a reasonable timeframe, the Court\u2019s analysis \u2013 and the weight accorded to these factors \u2013 will inevitably change.\u201d<\/span><\/p>\n<p><a href=\"https:\/\/www.breitbart.com\/politics\/2025\/06\/04\/fda-commissioner-is-committed-to-conducting-a-review-of-abortion-pill-safety\/\"><em><strong>READ MORE:\u00a0FDA Commissioner Is \u2018Committed\u2019 to Conducting a Review of Abortion Pill Safety<\/strong><\/em><\/a><\/p>\n<p><span style=\"font-weight: 400;\">The State of Louisiana, along with Rosalie Markezich \u2014 a woman <a href=\"https:\/\/www.cbsnews.com\/news\/louisiana-seeks-arrest-of-california-doctor-accused-of-mailing-abortion-pills\/\">who alleges<\/a> her boyfriend was able to order abortion drugs online from California and coerce her into taking the pills \u2014 filed a lawsuit against the FDA in October 2025. The lawsuit argues that the FDA acted unlawfully by loosening safeguards around mifepristone and allowing it to be sent via mail, including violating the Administrative Procedure Act (APA).\u00a0<\/span><\/p>\n<p class=\"a9d-pre\"><span style=\"font-weight: 400;\">The lawsuit specifically points to the Biden FDA\u2019s 2021 action that\u00a0<\/span><span style=\"font-weight: 400;\"><a class=\"\" href=\"https:\/\/www.nytimes.com\/2021\/12\/16\/health\/abortion-pills-fda.html\" target=\"_blank\" rel=\"noopener external\">removed<\/a>\u00a0the in-person dispensing requirement for abortion pills and allowed them to be sent via mail \u2014 a rule that the agency made permanent in 2023. That action, combined with\u00a0<a href=\"https:\/\/www.breitbart.com\/politics\/2025\/08\/12\/massachusetts-strengthens-shield-law-protecting-abortionists-out-state-investigations\/\">shield laws<\/a>\u00a0in blue states, have allowed abortionists to\u00a0<a class=\"\" href=\"https:\/\/www.nytimes.com\/2025\/10\/31\/health\/new-york-texas-abortion-shield-lawsuit.html\" target=\"_blank\" rel=\"noopener external\">mail abortion pills<\/a>\u00a0into red states with laws protecting the unborn. The state also points to a <a href=\"https:\/\/www.breitbart.com\/politics\/2025\/04\/28\/exclusive-shocking-data-suggests-abortion-pill-complications-22-times-higher-than-previously-reported-fda-must-reinstate-stronger-safeguards\/\">shocking 2025 study<\/a> suggesting that serious adverse health events from mifepristone are much higher than previously reported, along with the FDA\u2019s 2016 action requiring prescribers to report\u00a0<\/span>only fatalities but not serious adverse events.<\/p>\n<figure id=\"D-ROS-B2\" class=\"a9d\"\/>\n<figure id=\"M-ROS-B2\" class=\"a9d\"\/>\n<p><span style=\"font-weight: 400;\">Louisiana argues those FDA actions have undermined its laws restricting abortion and have imposed financial burdens on the state, specifically from Medicaid costs associated with emergency care after medication abortions.\u00a0<\/span><\/p>\n<p><iframe src=\"https:\/\/www.breitbart.com\/t\/assets\/html\/tweet-5.html#2041970228272242831\" data-btlnk=\"https:\/\/twitter.com\/AGLizMurrill\/status\/2041970228272242831\" class=\"bnn-if-tweet\" loading=\"lazy\" width=\"560\" height=\"260\" frameborder=\"0\" scrolling=\"no\" allowtransparency=\"true\" allowfullscreen=\"true\"><\/iframe><\/p>\n<p>\u201c[In a] post-<em>Dobbs<\/em> regulatory environment, there is evidence that the 2023 REMS [Risk Evaluation and Mitigation Strategies] was approved without adequate consideration, at least in part, as part of an effort to circumvent anti-abortion states\u2019 ability to regulate abortion,\u201d Judge Joseph acknowledged.<\/p>\n<p>He continued:<\/p>\n<blockquote>\n<p>Likewise, there is evidence that the consequences of this action were predictable \u2013 out-of-state providers and related entities would expand access to mifepristone in ways designed to reach into jurisdictions like Louisiana. These actions cause concrete and ongoing injury to Louisiana\u2026<\/p>\n<\/blockquote>\n<p>Attorney General Murrill said in a statement she would ask an appeals court to pause the FDA\u2019s mail-order abortion rule, and pointed out that Judge Joseph \u201cconcluded that Louisiana suffers irreparable harm every day\u201d the current rule is in effect.<\/p>\n<p><iframe src=\"https:\/\/www.breitbart.com\/t\/assets\/html\/tweet-5.html#2042358264583602363\" data-btlnk=\"https:\/\/twitter.com\/AGLizMurrill\/status\/2042358264583602363\" class=\"bnn-if-tweet\" loading=\"lazy\" width=\"560\" height=\"260\" frameborder=\"0\" scrolling=\"no\" allowtransparency=\"true\" allowfullscreen=\"true\"><\/iframe><\/p>\n<p>Judge Joseph wrote that even though the FDA has \u201cacknowledged\u201d the shortcomings of its procedural decisions, the agency should finish its safety review \u201cfree from judicial interference\u201d but with \u201cdeliberate speed.\u201d He ordered the FDA to produce the entire administrative record of safety decisions related to mifepristone within 60 days, file a status report within six months, and notify the court within 14 days of completing the safety review.<\/p>\n<p class=\"a9d-pre\"><em><strong><a href=\"https:\/\/www.breitbart.com\/politics\/2026\/01\/21\/online-map-tracks-scumbags-coerce-pregnant-women-abortion-pills\/\">READ MORE:\u00a0Online Map Tracks \u2018Scumbags\u2019 Who Coerce Pregnant Women into Taking Abortion Pills<\/a><\/strong><\/em><\/p>\n<figure id=\"M-ROS-B3\" class=\"a9d adSo\"\/>\n<p><span style=\"font-weight: 400;\">Mifepristone, the first drug taken in a two-drug medication abortion regimen, has been a battlefield since the Supreme Court <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/06\/24\/supreme-court-overrules-roe-v-wade-in-dobbs\/\">overturned<\/a> <em>Roe v. Wade<\/em> in 2022 with its <em>Dobbs<\/em>\u00a0decision. In 2024, the high court <a href=\"https:\/\/www.breitbart.com\/politics\/2024\/06\/13\/scotus-dismisses-abortion-pill-mandate-case-upholds-religious-liberty\/\">declined<\/a> to block Biden\u2019s mail-order abortion scheme, ruling that the doctors who brought the case lacked standing. The Supreme Court did not address the merits of that case.\u00a0<\/span><\/p>\n<p>As the FDA rule allowing telehealth abortions continues to stand, along with <a href=\"https:\/\/www.breitbart.com\/politics\/2025\/08\/12\/massachusetts-strengthens-shield-law-protecting-abortionists-out-state-investigations\/\">blue state shield laws,<\/a> many pro-life states are <a href=\"https:\/\/www.breitbart.com\/politics\/2026\/02\/12\/iowa-bill-would-ban-mail-order-abortion-pills-require-hospitals-to-track-complications\/\">trying to pass legislation<\/a> banning mail-order abortion pills.<\/p>\n<p>Data <a href=\"https:\/\/www.breitbart.com\/politics\/2024\/03\/21\/report-abortion-drugs-used-abortions-2023\/\">suggest<\/a> medication abortions make up\u00a0<span style=\"font-weight: 400;\">63 percent of all abortions within the formal U.S. healthcare system. A <a href=\"https:\/\/www.breitbart.com\/health\/2026\/03\/26\/report-1-1m-unborn-babies-killed-abortions-2025-telehealth-abortions-skyrocketed\/\">2025 report<\/a> indicated that telehealth abortions were a major contributor to the estimated 1.1 million abortions that occurred last year, with tens of thousands occurring in states that restrict abortion.\u00a0<\/span><\/p>\n<p><em><strong><a href=\"https:\/\/www.breitbart.com\/politics\/2024\/01\/11\/exclusive-heartbeat-international-president-jor-el-godsey-on-abortion-pill-reversal-protocol\/\">Exclusive: Heartbeat International President Jor-El Godsey on Abortion Pill Reversal Protocol<\/a><\/strong><\/em><\/p>\n<p>In a medication abortion, mifepristone\u00a0<a class=\"\" href=\"https:\/\/www.youtube.com\/watch?v=lRDnVSMr5j0&amp;feature=emb_title\" target=\"_blank\" rel=\"noopener external\">blocks<\/a>\u00a0the action of progesterone, which the mother\u2019s body produces to nourish the pregnancy. When progesterone is blocked, the lining of the mother\u2019s uterus deteriorates, and blood and nourishment are cut off to the developing baby, who then dies inside the mother\u2019s womb.
